1. Acceptance of Terms
By accessing, registering, or using the AppointMe: Salon Appointment Management Hub (“the System”), the user (“Data Subject”) agrees to comply with and be bound by these Terms and Conditions. Continued use constitutes acceptance of these terms pursuant to Republic Act No. 10173 (Data Privacy Act of 2012).
2. Purpose of the System
AppointMe is an online appointment and salon management system developed for 8th Avenue Salon. The System enables digital booking, scheduling, secure payment processing, inquiry handling, reporting, and administrative management. It is intended solely for lawful salon service transactions and internal operations.
3. User Accounts and Responsibilities
Users must provide complete, accurate, and updated personal information. Users are responsible for maintaining the confidentiality of their account credentials, including passwords and One-Time Passwords (OTP). All actions performed under a user account shall be presumed authorized by the account owner.
Unauthorized access, impersonation, or misuse of the System is strictly prohibited and may result in account suspension, termination, and legal action.
4. Collection and Processing of Personal Information
In accordance with the Data Privacy Act, the System collects and processes personal data for legitimate purposes such as:
- User registration and verification
- Appointment booking, scheduling, and service tracking
- Payment processing and invoice generation
- Customer communication and inquiry handling
- Reporting and system monitoring
Personal information collected may include name, contact details, email address, appointment details, and payment-related information. Processing is lawful, transparent, and limited to what is necessary.
5. Consent
By using the System, the Data Subject grants explicit, informed consent to the collection and processing of personal information as required under the Data Privacy Act. Consent withdrawal may be requested but shall remain subject to legal retention requirements and business necessity.
6. Sensitive Personal Information
The System does not require or intentionally collect sensitive personal information. Any sensitive data voluntarily provided will be processed only with explicit consent and in compliance with Section 13 of the Data Privacy Act.
7. Security of Personal Information
Consistent with Section 20 of RA 10173, the System implements appropriate organizational, physical, and technical security safeguards, including:
- OTP-authenticated login
- Encrypted data and restricted database access
- Role-based access control (User, Admin, Staff)
- Secure audit logs and archiving
In the event of a data breach, affected users and the National Privacy Commission (NPC) shall be notified as required by law.
8. Rights of the Data Subject
Users are entitled to all rights under Chapter IV of RA 10173, including:
- Right to be informed
- Right to access
- Right to correct
- Right to object
- Right to erasure/blocking
- Right to data portability
- Right to damages
Requests may be filed through the salon’s official communication channels.
9. Appointment Booking, Payments, and Transaction Policies
9.1 Payment-First Policy
- All bookings require advance payment through the System.
- Appointments are not confirmed until payment is successfully completed.
9.2 Automatic Cancellation of Unpaid Appointments
- If a user exits or leaves the payment process unfinished, the appointment will be automatically cancelled and the system will not reserve the slot.
9.3 One-Time Rescheduling Policy
- Customers are allowed one (1) reschedule attempt only per confirmed appointment.
- Further rescheduling shall not be permitted and will require a new booking.
9.4 Cancellation and No-Show Policy
- Cancellations must be made before the allowed cut-off period set by the salon.
- Customers who fail to appear (no-show) at their scheduled appointment will forfeit the payment.
- No-show appointments will not be eligible for rescheduling, transfer, or refund.
9.5 No Refund / No Rebate Policy
- All payments made through the System are final and non-refundable.
- The salon and the System will not grant any form of refund, rebate, reversal, or compensation for:
- Cancelled appointments
- No-shows
- Unfinished or abandoned payment procedures
- User errors during booking
- Failure to use the appointment slot
By booking through the System, the user agrees to this strict no-refund policy.
10. System Use Limitations
Users shall not:
- Use the System for fraudulent or unlawful purposes
- Attempt to breach system security or access data without authorization
- Upload malicious software
- Violate the privacy or security rights of others
Violations may result in suspension, account termination, and legal action.
11. Data Retention and Archiving
Personal information is retained only as long as necessary to fulfill declared purposes or comply with legal obligations, in accordance with Section 11(e) of the Data Privacy Act. Archived records are securely stored and accessible only to authorized personnel.
12. Administrative Authority
8th Avenue Salon, as the Personal Information Controller, is responsible for ensuring compliance with the Data Privacy Act. Authorized administrators manage appointments, customer records, and system operations consistent with internal policies and legal standards.
13. Limitation of Liability
The System developers and administrators shall not be liable for damages arising from:
- User misuse or negligence
- Failed or interrupted internet connection
- Third-party payment gateway disruptions
- Events beyond reasonable control
Liability applies only where required by Philippine law.
14. Amendments
These Terms and Conditions may be updated for compliance, system enhancements, or policy changes. Users will be notified of significant revisions.
15. Governing Law
These Terms and Conditions shall be governed by the laws of the Republic of the Philippines, including but not limited to Republic Act No. 10173 (Data Privacy Act of 2012) and its Implementing Rules and Regulations.
